You should only consider filing bankruptcy if you owe substantial debt that you believe that you cannot pay. The filing of bankruptcy will drastically reduce your credit score and make it difficult for you to obtain credit. Many organizations offer their services to help debtors work out payment plans with their creditors that can prevent the filing of bankruptcy.
If you decide that you have to file bankruptcy, you will generally choose to either file a Chapter 7 or a Chapter 13 bankruptcy petition. When you file a Chapter 7 or Chapter 13 petition, you are asking the Bankruptcy Court to issue a discharge order that bars your creditors from taking any legal action to collect the debts that you owe.
In a Chapter 7 case, you are asking the Bankruptcy Court to issue an Order of Discharge without having to pay any amount to your unsecured, non-priority creditors. In a Chapter 13 case, you submit a plan asking the court to grant you a discharge after you pay an amount that you propose to pay to your creditors.
