If you are not the parent of a child, but want the child to live with you rather than with the child’s parents, you can file a Non-Parental Custody Petition. With the petition, you must submit evidence to prove that the child is not in the physical custody of the child’s parents or that neither parent is suitable custodian for the child. Case Law in Washington establishes that, for a court to find that both of a child’s parents are not suitable custodians for the child, it must decide that both parents are either unfit or cannot meet the needs of the child.
